Scope of Services
1. Scope of Services:
Oklahoma Mold Dog & Consulting LLC provides canine mold detection services. Our trained dogs and handlers will conduct a visual and olfactory inspection of the property to identify potential mold presence.
This inspection is a non-invasive assessment. We do not perform any invasive testing,such as wall demolition or sample collection.
The canine inspection is one tool to use in an overall mold investigation, and is not the only tool that should be used.
We do not write a protocol for remediation.
Limitations and Disclaimers
2. Limitations and Disclaimer:
No Guarantees: Oklahoma Mold Dog & Consulting LLC does not guarantee the complete absence of mold or the accuracy of the dog's findings. Canine detection is a highly effective tool, but it is not infallible.
No Liability for Remediation: Oklahoma Mold Dog & Consulting LLC is not responsible for any remediation, remodeling, demolition, or other related costs incurred as a result of our inspection. Any remediation decisions are solely the responsibility of the client.
Third-Party Testing: Oklahoma Mold Dog & Consulting LLC recommends that clients
consider independent third-party testing to confirm the presence and type of mold identified by our canine inspection.
Odor Availability: Client acknowledges that the canine can only detect mold odor if it is actively available. Mold odor may be contained within walls, under flooring, or in other concealed areas, and may not always be detectable. Additionally, mold odors located at heights exceeding approximately 10 feet, such as in high ceilings (e.g., 18-foot ceilings), are generally beyond the detection range of the canine.
Property Damage: Client acknowledges that Oklahoma Mold Dog & Consulting LLC is not responsible for potential property damage caused by the canine during the inspection, including but not limited to scratched cabinets, knocked-over lamps, or other incidental damage.
Client Responsibilities
3. Client Responsibilities:
Pet Control: All pets and animals must be securely confined or removed from the
premises prior to and during the inspection. Failure to comply will result in the
cancellation of the appointment, and any deposits will be retained.
Access: Client must provide clear and unobstructed access to all areas of the property to be inspected.
Safety: Client is responsible for ensuring the safety of the handler and dog on the
property. Any known hazards must be disclosed prior to the appointment.
Access: Request access to the personal information we hold about you.
Correction/Rectification: Request correction of inaccurate or incomplete personal
information.
Deletion: Request deletion of your personal information, subject to certain exceptions.
Opt-Out of Marketing: Opt-out of receiving marketing communications, including text messages, at any time.
Data Portability: Request a copy of your personal information in a structured, machine-readable format.
Withdraw Consent: Withdraw your consent where we rely on consent to process your personal information.

Deposits, Cancellations & Rescheduling
4. Deposits and Cancellations: Oklahoma Mold Dog & Consulting LLC Driving To
Client
If driving to clients home- A non-refundable deposit of $XXX is required to secure the appointment.
In the event of a cancellation, the $XXX deposit will be retained by Oklahoma Mold Dog & Consulting LLC. The client may apply this deposit towards a future booking, provided the new booking is scheduled within three (3) months of the original cancellation date.
Cancellations made less than 48 hours prior to the appointment will result in the forfeiture of the deposit and the client will not be able to use it for future bookings.
Oklahoma Mold Dog & Consulting LLC reserves the right to reschedule or cancel appointments due to unforeseen circumstances.
Non-Refundable Nature (Partial Refund): Oklahoma Mold Dog & Consulting LLC
Flying to Client
A non-refundable deposit of 50% of the total estimated service fee is required to secure your appointment and initiate the scheduling process.
The deposit serves as confirmation of your commitment to the scheduled service and covers initial expenses related to travel and preparation.
While the initial deposit is non-refundable, in the event of cancellation by the client, a partial refund may be issued, less any direct expenses already incurred by Oklahoma Mold Dog & Consulting LLC.
Direct expenses include, but are not limited to:
Fuel costs for the trip.
Mileage costs $2 per mile.
Any overnight accommodation costs already paid (if applicable).
Any non-refundable travel related costs.
Cancellations made less than 48 hours prior to the appointment will result in the
forfeiture of the deposit and the client will not be able to use it for future bookings.
Oklahoma Mold Dog & Consulting LLC reserves the right to reschedule or cancel appointments due to unforeseen circumstances.
5. Confidentiality:
Oklahoma Mold Dog & Consulting LLC will keep client information confidential.
Client agrees that Oklahoma Mold Dog & Consulting LLC can use photos and videos of the dog working, but will not disclose the location of the home, or the clients personal information.
Photos, Video, and IP Rights
Video Usage: Client acknowledges that if video is taken or used by Oklahoma Mold Dog & Consulting LLC, the client will not receive any compensation for the video performance. These videos are for educational purposes only.
10. Photos and Videos:
All photos and videos taken during the inspection are the sole property of Oklahoma Mold Dog & Consulting LLC. Oklahoma Mold Dog & Consulting LLC reserves the right to use these materials for marketing, training, or other business purposes.
Indemnification
6. Indemnification:
Client agrees to indemnify and hold Oklahoma Mold Dog & Consulting LLC, its officers, employees, and agents harmless from any and all claims, liabilities, damages, and expenses (including reasonable attorney's fees) arising out of or related to Client’s breach of this agreement or any negligent acts or omissions.
Limitation of Liability
7. Limitation of Liability:
In no event shall Oklahoma Mold Dog & Consulting LLC's liability exceed the amount paid by Client for the services provided under this agreement.
Dispute Resolution
8. Dispute Resolution:
Any disputes arising out of or related to this agreement shall first be submitted to non-binding mediation. If mediation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
9. Weather or Unforeseen Delays:
Oklahoma Mold Dog & Consulting LLC reserves the right to reschedule or cancel appointments due to inclement weather, hazardous conditions, or other unforeseen circumstances that may affect the safety or effectiveness of the inspection.
Force Majeure
10. Force Majeure:
Oklahoma Mold Dog & Consulting LLC shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, and government regulations.
Governing Law & Entire Agreement
11. Entire Agreement:
This agreement constitutes the entire agreement between Oklahoma Mold Dog & Consulting LLC and the client.
Severability and Waiver
12. Severability and Waiver:
If any provision of this agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The failure of either party to enforce any provision of this agreement shall not constitute a waiver of that provision or any other provision.
Definitions
13. Definitions:
“CANINE”: Refers to the trained canine used for mold detection.
“Client”: Refers to the individual or entity contracting Oklahoma Mold Dog & Consulting LLC’s services.
“Inspection”: Refers to the canine mold detection service provided by Oklahoma Mold Dog & Consulting LLC.
“Odor”: Refers to the scent produced by mold that the canine is trained to detect.

Disclaimer: Our inspection is not intended for legal proceedings, insurance claims, or
regulatory compliance without corroborating testing by a certified mold assessor or
laboratory. While our canine teams are trained and reliable, scent-based inspection results
are inherently subjective and dependent on environmental factors. Results should not be
used as a substitute for laboratory-based mold testing.
Emergency Rescheduling: Rescheduling due to verified emergencies may be honored at
our discretion. Clients must contact us within 24 hours of the missed appointment to be
considered for partial credit.
All disputes will be resolved under the laws of the State of Oklahoma. Venue shall be
Tulsa County, Oklahoma.
